GENERAL TERMS AND CONDITIONS (GTC)

1. Accommodation Agreement

1.2.The accommodation agreement is concluded when the host confirms the guest’s inquiry by phone or in writing via email and the guest pays the full amount within 7 days of receiving the booking confirmation, but no later than before check-in.

1.3.The contract is between the host and the guest. If a third party has made the booking for the guest, that third party is liable to the host together with the guest as joint debtor for all obligations arising from the contract, provided the host has received a corresponding declaration from the third party.

1.4.The guest is required to check the booking confirmation for accuracy and provide all information truthfully. If the booking confirmation differs from the original inquiry and the guest does not immediately object, the contents of the booking confirmation are considered contractually agreed.

1.5.The host processes the guest’s personal data exclusively for contract execution and in accordance with legal requirements. The privacy policy on the host’s website applies.


2. Prices and Payment

2.1.The guest is obligated to pay the applicable or agreed prices of the host for the use of the apartment and any additional services used (e.g., minibar).

2.2.Apartments may only be occupied by the number of persons stated in the booking confirmation. Any excess requires prior written approval from the host. The price increases by €30.00 per night for each additional guest.

2.3.Payment is accepted via PayPal, credit card, or bank transfer. It must be made within 7 days of booking and no later than before check-in. The booking becomes binding only upon receipt of payment.

2.4.In case of non-payment, the host may cancel the booking without further notice.

2.5.A final cleaning fee and any applicable local tax will be charged additionally, if stated in the booking confirmation.


3. Arrival/Departure, Handover

3.1.Check-in is available daily from 3:00 p.m. after full payment. Check-out must be completed by 11:00 a.m. on the day of departure. If this time is exceeded by more than 60 minutes, an additional night’s stay will be charged.

3.2.In the case of delayed departure that affects subsequent bookings, the guest is liable for any replacement accommodation costs.

3.3.If the guest does not arrive by 10:00 p.m. on the day of arrival without prior notice, the booking is considered cancelled.

3.4.The apartment is handed over contactlessly, usually via a code lock at the entrance and apartment doors. The guest must report any obvious defects or damages by phone or email within 60 minutes of check-in. If no report is made, the apartment is considered accepted without defects.


4. Cancellation, Refund, Withdrawal

4.1.The guest may cancel at any time in writing, by email, or by phone.

4.2.The following refund rules apply:


  • 100% refund for cancellations up to 14 days before check-in.
  • 50% refund for cancellations up to 7 days before check-in.
  • No refund for cancellations within 7 days of check-in.


4.3.The host may cancel the booking up to 30 days before arrival without providing any reason. In this case, 100% of any payments already made will be refunded.

4.4.A contractually agreed right of cancellation may be mutually excluded.

4.5.Notice pursuant to § 312g (2) No. 9 of the German Civil Code (BGB): There is no right of withdrawal for short-term accommodation with a fixed booking period.


5. General Rights and Obligations

5.1.The guest must treat the apartment and its furnishings with care. Quiet hours are from 10:00 p.m. to 7:00 a.m. Consideration for other residents and neighbors must be observed.

5.2.When leaving the apartment, windows and doors must be closed, and lights and appliances must be turned off. The guest is liable for any damage caused by leaving windows or doors open (e.g., during a storm).

5.3.Smoking is not permitted in the apartments. A cleaning fee of up to €200.00 will be charged for violations.

5.4.Use of the internet is at the guest’s own risk. Any illegal activity will be reported to the authorities. The guest is liable for unlawful use.

5.5.In case of imminent danger or after the rental period has ended, the host has the right to access the apartment.

5.6.The building’s entrance and stairwell areas are monitored by video for security reasons. Video surveillance is carried out in accordance with applicable data protection regulations under Art. 6(1)(f) GDPR (legitimate interest in the safety of persons and property). Recordings are not stored permanently and are only reviewed in the event of an incident, then deleted.


6. Liability and Security Deposit

6.1.The host is not liable for disruptions caused by force majeure (e.g., power, water, or internet outages, storms, official orders).

6.2.Arrival and departure are at the guest’s own risk. The host is not liable for theft or loss of personal belongings.

6.3.The guest is liable for any damage caused by themselves, their fellow travelers, or visitors. Damage must be reported immediately, especially if it could affect other units (e.g., water damage).

6.4.For stays of 14 days or more, a security deposit of €500 will be required. This will be refunded within 14 days after departure, provided there are no claims.

6.5.Guest claims expire after six months, unless the host acted intentionally. Claims by the host are subject to the statutory limitation periods.


7. Use and Subletting

Subletting or any use of the apartment for purposes other than normal living or staying is not permitted without the host’s written consent.


8. Pets

Pets are generally allowed. An exception applies to the Comfort Apartment – pets are not permitted there. In the case of a violation, a cleaning fee of up to €200.00 will be charged.


9. Final Provisions

9.1.Images and descriptions on the website or in flyers are for realistic representation but do not guarantee complete accuracy. The host reserves the right to make equivalent changes to the furnishings.

9.2.Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by one that comes closest to its intended purpose.

9.3.German law applies. The place of jurisdiction, where legally permitted, is the host’s place of residence.
